PineProof Terms of Service

These Terms of Service ("Terms") govern access to PineProof (the "Service").

1. Acceptance

By using PineProof, uploading files, viewing public audit pages, downloading PDFs, or purchasing access, you agree to these Terms. If you use PineProof for an organization, you confirm that you are authorized to bind that organization.

2. Service Description

PineProof provides TradingView strategy audit tooling, CSV analysis, optional Pine source static checks, walk-forward metrics, Monte Carlo drawdown simulations, public audit pages, and generated PDF reports. PineProof is informational only. It does not provide trading instructions, portfolio advice, ratings, signals, or proof that a strategy will work live.

3. Accounts

You are responsible for the accuracy of uploaded files, strategy names, Pine source, billing information, and access credentials. Paid access may be tied to a Stripe customer ID or browser cookie. Tell us promptly if you believe your access has been misused.

4. Prohibited Uses

You may not use PineProof to break the law, violate third-party rights, upload malware, submit files you do not have the right to use, overload our systems, bypass rate limits, reverse engineer private parts of the Service, remove risk notes or notices from reports, or present output as guaranteed, certified, complete, professional advice, or a recommendation to buy, sell, hold, trade, deploy, or allocate capital.

5. Payments and Refunds

Paid plans, if offered, are charged at the price shown at checkout. Stripe may process payments. Taxes may apply. Unless a separate written refund policy says otherwise, fees are non-refundable after PineProof begins processing a requested audit, report, export, or subscription period. We may issue refunds at our discretion.

6. Cancellation

You may cancel future paid access through the product flow, Stripe portal if available, or by contacting us. Cancellation stops future charges but does not automatically delete prior generated output. Retention policy: uploaded strategy files are retained for 30 days; audit PDFs are retained indefinitely for paid users and 14 days for anonymous users.

7. Intellectual Property

We retain all rights in PineProof, software, templates, design, trademarks, scoring copy, and product copy. You retain rights in files, strategy code, trade lists, and content you submit. You grant us a limited license to host, process, transform, display, and transmit submitted content as needed to provide the Service and operate security, support, and billing workflows.

8. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not promise uninterrupted access, complete accuracy, error-free output, complete Pine compatibility, live-market performance, regulatory compliance for your use case, or that every uploaded file will be parsed correctly.

9. Liability Cap

To the maximum extent allowed by law, our total liability for claims related to PineProof is limited to the greater of the amount you paid for the Service in the three months before the claim or USD $100. We are not liable for indirect, incidental, special, consequential, exemplary, lost-profit, lost-data, trading-loss, business-interruption, or reputational damages.

10. Indemnity

You agree to defend and indemnify us from claims, damages, losses, costs, and fees arising from your use of PineProof, your submitted files or code, your violation of these Terms, or your violation of law or third-party rights.

11. DMCA and Copyright Complaints

If you believe content in PineProof infringes your copyright, send a notice with the copyrighted work, the allegedly infringing material, your contact information, a statement of good-faith belief, a statement that the notice is accurate, and your signature. Send notices through the public product contact channel, currently @publicmargin. We may remove content and terminate repeat infringers when appropriate.

12. Governing Law

These Terms are governed by {GOVERNING_LAW_PLACEHOLDER}, excluding its conflict-of-law rules. Venue, arbitration, and consumer-law wording should be reviewed after this placeholder is resolved.

13. Changes to Terms

We may update these Terms when PineProof changes or legal requirements change. We will update the effective date and, for material changes, provide reasonable notice through the product or contact channel. Continued use after changes means you accept the updated Terms.
